Land disturbing activities that are not meticulously planned can cause pollution to our rivers. streams, lakes and ponds as well as causing erosion of valuable soil. A myriad of problems can arise from an improperly maintained site including decreased water quality, altered ecosystems, property  devaluation and increased cost of clean drinking water.

Fines for non-compliance with the E&S Act can be steep. Lee County Authorities can fine violators as much as $2,500.00 per day for each violation. A notice of the violation is sent out and if the violation isn't corrected within five days, a second notice is sent out. Failure to comply with the laws after that can result in a stop work order delivered along with a court citation. At this point the construction on the site comes to a complete standstill. A major event can trigger an immediate stop work order without the benefit of written warnings.  If you receive 3 violations within a twelve month period, a bond will be required for any new projects. The bond is $3,000.00 per acre or a fraction thereof. After a bond is imposed, there has to be a period of twelve months with no violations in order to lift the bond requirements.

Muddy Water
In order to quell some of the problems associated with land developement, the state of Georgia inacted the Georgia Erosion and Sedimentation Act. It was passed in 1975 and became effective in 1977. It has been amended several time's; in 1980, 1985, 1994, 1995 and 2000. The final product is legislation that requires any and all persons involved in land development, design, review, permitting, construction, monitoring or inspection of any land-disturbing activity to meet specified education and training certification requirements, dependent on their level of involvement as developed by the Commission in consultation with the EPD and the Stakeholder Advisory Board.

In addition to Wayne, we have seven other E&S Certified technicians on staff. Wayne and his crew install construction entrances and silt fencing and inspect the lots daily until final stabilization is acheived.
